These Terms of Service (“Terms”) govern your access to and use of the Vestigo website and application (the “Service”). “Vestigo,” “we,” “us,” and “our” mean Vestigo. “You” means the person or organization using the Service.
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and Authority
You must be at least 18 years old, or the age of majority where you live, to use the Service. If you use Vestigo on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts and Security
You must provide accurate and current account information and keep it updated. You are responsible for safeguarding your login credentials and for activity that occurs through your account.
You may authenticate with Vestigo using Google OAuth. Google provides basic account information needed to create and authenticate your Vestigo account. Google sign-in does not give Vestigo access to your Gmail, Google Drive, Google Calendar, or other Google services.
Notify us promptly at privacy@tryvestigo.com if you believe your account has been accessed without authorization. You may not share account credentials, impersonate another person, or create an account using information you do not have the right to use.
3. Workspaces and Team Members
Vestigo allows you to create workspaces, invite team members, assign roles, and share workspace data. You are responsible for:
- choosing appropriate workspace members and permissions;
- ensuring that invited users are authorized to access the workspace;
- complying with agreements and privacy obligations relating to information you submit; and
- all activity and content associated with your workspace.
Workspace administrators may be able to manage members, workspace settings, subscriptions, and workspace data.
4. Your Content
You retain ownership of the prompts, website information, competitor information, text, and other material that you submit to the Service (“Your Content”).
You grant Vestigo a limited, non-exclusive, worldwide license to host, reproduce, process, transmit, and modify Your Content only as reasonably necessary to operate, secure, maintain, and improve the Service and provide the features you request.
You represent that you have all rights and permissions necessary to submit Your Content and to authorize Vestigo and its service providers to process it. Do not submit personal information, confidential information, copyrighted material, or other data unless you are authorized to do so.
5. AI, Search, and Research Results
Vestigo may send prompts, website information, competitor information, and related research inputs to third-party AI, search, scraping, and workflow providers in order to provide the Service.
Results may be generated or assisted by automated systems and may be incomplete, inaccurate, outdated, or unsuitable for your particular purpose. You must independently verify results before relying on them for business, legal, financial, compliance, marketing, or other important decisions. Vestigo does not guarantee that results are accurate, complete, current, or free from third-party rights claims.
6. Plans, Trials, and Usage Limits
Vestigo may offer a free trial or other promotional access. The current trial may be limited to seven days, ten prompts, and up to three models per prompt. We may change, suspend, or discontinue trial eligibility or promotional terms where permitted by law.
Paid plans may include Base, Pro, and Ultra tiers with monthly or yearly billing. Each plan may have limits on prompts, answers, models, tracked prompts, features, or other usage. Current limits are described on the applicable pricing page and may be enforced automatically.
You may not circumvent usage limits, create multiple accounts to avoid limits, or use automated means to access the Service unless we have expressly authorized it.
7. Subscriptions and Payment
Paid subscriptions are billed in advance on a recurring monthly or yearly basis through Stripe. By starting a subscription, you authorize Stripe to charge the selected payment method for the applicable plan, billing interval, taxes, and other amounts disclosed at checkout.
Subscription prices and plan features may change. We will provide notice of material price or feature changes where required by law. Changes generally apply at the beginning of the next billing period unless otherwise stated.
Stripe processes payment-card information. Vestigo does not store your full payment-card number.
8. No Refunds
All subscription payments are non-refundable, and Vestigo does not provide refunds or credits for partial billing periods, unused prompts, unused features, downgrades, or account inactivity.
If a payment is duplicated or charged in error, contact us promptly at support@tryvestigo.com so we can review it. Nothing in this section limits refund or cancellation rights that cannot lawfully be excluded in your jurisdiction.
9. Cancellation
You may cancel a subscription through the available billing-management or Stripe customer-portal controls. Cancellation normally takes effect at the end of the current paid billing period, and you may continue to use paid features until then unless your account is suspended or terminated.
Canceling a subscription does not automatically delete your account or Your Content. Account deletion and workspace deletion may be subject to separate controls and retention obligations.
10. Acceptable Use
You may not use the Service to:
- violate any law, regulation, or third-party right;
- submit content that is unlawful, fraudulent, defamatory, threatening, harassing, hateful, sexually explicit, or invasive of privacy;
- upload malware or interfere with the security, operation, or availability of the Service;
- reverse engineer, copy, resell, lease, or substantially reproduce the Service;
- scrape or access the Service through unauthorized automated means;
- evade authentication, rate limits, quotas, or plan restrictions; or
- use results or the Service to make decisions where errors could cause serious harm without appropriate human review.
We may investigate suspected violations and remove content, restrict access, or suspend an account when reasonably necessary to protect the Service, users, or others.
11. Intellectual Property
The Service, including its software, design, branding, documentation, and features, is owned by Vestigo or its licensors and is protected by applicable intellectual-property laws. These Terms grant you a limited right to use the Service during the applicable subscription or authorized access period. No ownership rights are transferred to you.
If you send us suggestions or feedback, you grant us permission to use that feedback without restriction or compensation, provided we do not identify you publicly as the source without your permission.
12. Third-Party Services and Links
The Service may integrate with or link to third-party services, including payment, authentication, email, AI, search, scraping, hosting, and workflow providers. This includes Google OAuth for optional account authentication. Those services are governed by their own terms and privacy policies. Vestigo is not responsible for third-party services that it does not control.
13. Availability, Backups, and Changes
We work to keep Vestigo available and reliable, but the Service may be unavailable, delayed, or changed due to maintenance, updates, outages, security incidents, or circumstances outside our control.
You are responsible for maintaining copies of important Your Content. We do not guarantee that backups will always be complete, current, or recoverable.
We may modify, suspend, or discontinue features of the Service. If we discontinue a material part of a paid Service, we will provide any notice or remedy required by applicable law.
14. Suspension and Termination
We may suspend or terminate access if you breach these Terms, fail to pay, create security or legal risk, abuse the Service, or use the Service in a way that could harm Vestigo or others. Where reasonable, we will provide notice and an opportunity to resolve the issue.
You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including provisions concerning payment obligations, ownership, acceptable use, disclaimers, limitations of liability, and dispute resolution.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” VESTIGO DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
Vestigo does not guarantee that the Service or its results will meet your requirements, remain available, produce a particular outcome, or be accurate or complete.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESTIGO AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VESTIGO’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID VESTIGO FOR THE SERVICE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 100 USD.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Vestigo and its service providers from claims, damages, liabilities, costs, and expenses arising from Your Content, your use of the Service, your violation of these Terms, or your violation of another person’s rights.
18. Governing Law and Disputes
Before bringing a formal claim, you agree to contact us at privacy@tryvestigo.com and give us a reasonable opportunity to resolve the issue informally.
These Terms are governed by the laws applicable to Vestigo’s operating location, excluding conflict-of-law rules, unless mandatory consumer-protection laws in your jurisdiction provide otherwise. The appropriate courts for a dispute will be determined under applicable law.
19. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. If a change is material, we will provide additional notice where required by law. Your continued use of the Service after the effective date means you accept the revised Terms.
